Some time in the next 24 hours an article revealing the testimony of TIME reporter Viveca Novak will be posted on the magazine’s web site. Unconfirmed stories have it that she told the grand jury that she had reminded Rove’s lawyer, Robert Luskin, of the leak of the CIA agent’s identity from Karl Rove to Matt Cooper before Rove’s first testimony to the grand jury (in which he could not recall leaking the agent’s identity to anyone). If this is the timing she testified to of her conversation with Luskin, it means that the only reason that Rove was not indicted on October 28th is because Luskin lied to the prosecutor, Fitzgerald, about this conversation in a desperate bid to delay the indictment. And it means that Rove is in even more trouble than he would have been had this lie not delayed the indictment, and it also means that Luskin is in trouble too, for lying as a witness (perjury) under oath to the grand jury himself. Rove will be indicted, and before the month is out. Place your bets now.
