A Justice Dept. letter to Bush has been obtained by the Washington Post, which in turn provided the blueprint for the Pentagon legal report that was described in the Wall Street Journal yesterday. Both documents contained one key argument: that torture was justified only if the President directly approved it, and that anyone charged with illegalities in connection with in torture could in turn fall back on his authority to avoid conviction under US and international laws, and treaties. How long before the 7 accused MPs’ lawyers take advantage of this?
